Privacy Policy

Last updated: 5 May 2026

Introduction

NZXplorer ("we", "us", "our") is a governance and capital-markets transparency platform for NZX-listed issuers. This page explains how we handle personal information under the New Zealand Privacy Act 2020, both for the named individuals we publish profile information about (NZX directors, executives, substantial product holders) and for visitors to nzxplorer.co.nz and our associated platforms (charitydata.co.nz, iwidata.co.nz, publicdata.co.nz).

The full editorial floor — including our source authority, methodology disclosure for analytical labels, search-engine indexing rules, and right-of-reply pathways — is set out on our Data Principles page. This privacy policy is the legal companion to that document.

Information we publish about NZX directors, executives and shareholders

We publish profile information about named individuals who are directors, executives, substantial product holders, or earnings-call participants of NZX-listed issuers. This is personal information under the Privacy Act 2020, and our publication of it is subject to the Act. The information is sourced from statutory public registers and continuous-disclosure filings, and our republication relies on the "publicly available publication" exception in Privacy Act 2020 sections 7 and 22 (IPP 11(e)(iii) / IPP 12(d)). The information we publish includes:

  • Name, role, issuer, appointment and resignation dates
  • Biographical information voluntarily published in annual reports or board materials
  • Director fees, executive remuneration (salary / STI / LTI / total) as disclosed under Companies Act §211 and NZX Listing Rule 3.6
  • Shareholdings, insider trades and substantial product holder notices as disclosed under FMC Act §274–290
  • Earnings-call Q&A turns where the individual is a named questioner or answerer (sourced from publicly broadcast webcasts)
  • Cross-platform governance roles (Companies Office director records, charity board roles, iwi governance roles, MP/councillor records)
  • Photographs published by the issuer as part of its annual-report or leadership materials

We also publish proprietary analytical labels and scores (Governance Risk Score, CEO Pay vs Returns pattern detector, dividend-cut probability, "Active shareholder voice" classification, etc.). These are analytical observations with disclosed methodologies, not statements of fact. Methodology pages are linked from every surface that uses a label. Any individual named in connection with one of these labels has a right of reply via the dispute form.

We do not publish home addresses (we honour Companies Act §367AA suppression), personal email addresses, personal phone numbers, dates of birth, or photographs of minors. The full list of categories we always remove on request is on the Data Principles page.

Cookies and tracking

We use two categories of cookies in accordance with the NZ Privacy Act 2020:

  • Essential cookies — required for authentication and site functionality (Supabase session). These cannot be disabled.
  • Analytics cookies — Google Analytics with IP anonymisation enabled. These are only loaded after you consent via our cookie banner. You may opt out at any time by clearing your browser storage or selecting "Essential Only".

We do not sell visitor personal information or use tracking for advertising purposes. Analytics data is aggregated and anonymised.

How we use information

We use the information we collect to:

  • Provide the public, Pro, Enterprise and Institutional product tiers described on the pricing page

Service providers and disclosure

We do not sell, trade, or rent visitor or account-holder personal information to third parties. We may share information in the following situations:

  • Service providers: Supabase (database hosting and authentication), Stripe (payment processing), Netlify (website hosting), Sentry (error tracking), and Anthropic (AI-powered data extraction). These providers process data only as necessary to perform their services and are bound by confidentiality obligations.
  • Payment processing: When you subscribe to a paid plan, your payment information is processed directly by Stripe. We do not store your credit card details. We receive only your Stripe customer ID, subscription status, and billing history.
  • Legal obligations: We may disclose information if required by law or in response to valid requests from public authorities (Office of the Privacy Commissioner, FMA, NZX, courts, etc.).
  • Business transfers: We may share or transfer information in connection with a merger, sale of company assets, financing, or acquisition of all or a portion of our business.

Note:the published-subject information described in the section above (NZX director profiles etc.) is itself published to the public via nzxplorer.co.nz; that publication is the purpose for which the information was collected, and is the "disclosure" permitted by IPP 11(e)(iii).

Data security

We implement appropriate technical and organisational security measures to protect personal information. The Site uses HTTPS encryption to secure data in transit. No method of transmission over the Internet or electronic storage is 100% secure.

Third-party links

The Site may contain links to third-party websites (such as NZX announcement PDFs, issuer websites, or external resources). We are not responsible for the privacy practices or content of these third-party sites.

Your rights under the Privacy Act 2020

Under the Privacy Act 2020 you have the right to:

  • Access the personal information we hold about you (IPP 6)
  • Correct inaccurate or incomplete personal information (IPP 7)
  • Submit a right-of-reply for any data point or analytical observation we have published about you
  • Request removal of personal data that is not statutorily-public-by-design (photos, personal contact details, home addresses, suppressed-identity information)
  • Withdraw consent for processing based on consent (e.g. analytics cookies)
  • Complain to the Office of the Privacy Commissioner if you believe we have breached your privacy

The fastest way to exercise these rights is the public dispute & right-of-reply form, which goes to our editorial review queue with a 5-business-day response target. Alternatively, email hello@nzxplorer.co.nz.

Data retention

We retain visitor and account-holder personal information only for as long as necessary to fulfil the purposes outlined in this policy, unless a longer retention period is required or permitted by law. Published-subject information (NZX director profiles etc.) is retained as a long-term governance archive — this is necessary to maintain the cross-platform historical record that is the purpose of the Site, and is consistent with how the Companies Office, Charities Services and FMA Disclose Register themselves retain historical filings.

Children’s privacy

The Site is not intended for use by children under 16. We do not knowingly collect personal information from children under 16, and we do not knowingly publish profile information about minors. If you believe we hold or have published information about a minor, please contact us immediately and we will remove it.

Changes to this policy

We may update this Privacy Policy from time to time. We will post the new Privacy Policy on this page and update the "Last updated" date.

Indirect-collection notice (Information Privacy Principle 3A)

Required disclosure under the Privacy Act 2020, in force from 1 May 2026.

This notice satisfies the indirect-collection disclosure duty in IPP 3A for personal information we collect about NZX-listed-issuer directors, executives, substantial product holders and earnings-call participants from public registers and other publicly-available publications. Where the source information is publicly available, the IPP 3A "publicly available information" exception also applies; we publish this notice in addition, so that every data subject knows what we hold and how to access or correct it.

(1) The fact of collection

NZXplorer collects personal information about the individuals named above and republishes it on NZXplorer (nzxplorer.co.nz) for the purpose described in (2) below.

(2) Purpose of the collection

To provide a searchable, cross-referenced governance and transparency record for journalists, funders, regulators, researchers, and the wider public; to support the regulatory and statutory disclosure regimes listed in (5) below; and to operate the commercial subscription products described on the site.

(3) Intended recipients

The general public via NZXplorer (nzxplorer.co.nz); verified researchers and Pro-tier subscribers via gated access for higher-detail disclosures; the Office of the Privacy Commissioner, Charities Services, the Financial Markets Authority, the Companies Office, and other regulators on lawful request; our service providers (Supabase, Netlify, Stripe, Sentry, Anthropic) acting under confidentiality obligations.

(4) Agency name and address

NZXplorer, publisher of NZXplorer (nzxplorer.co.nz). Privacy contact: hello@nzxplorer.co.nz.

(5) Lawful authority for collection

We rely on the "publicly available publication" exception in sections 7 and 22 of the Privacy Act 2020 (IPP 11(e)(iii) and IPP 12(d)) for republication of information that is already on a statutory public register or has been voluntarily published by the data subject or their organisation. The specific source registers and statutory regimes are:

  • NZX market announcements and continuous disclosure filings
NZX Listing Rules; Financial Markets Conduct Act 2013 §270
  • Annual reports and audited financial statements lodged with NZX
Companies Act 1993 §211; NZX Listing Rule 3.6
  • Substantial Product Holder notices, insider trades and director-interest disclosures
Financial Markets Conduct Act 2013 §274–290 (FMA Disclose Register)
  • Companies Office (NZBN, director and shareholder records, beneficial-ownership data)
    Companies Act 1993 §215; NZBN Act 2016
  • NZ Government Gazette appointment notices
Acts and Regulations Publication Act 1989; Crown Entities Act 2004
  • Public registers maintained by FMA, RBNZ, Commerce Commission and other Crown regulators
Sector-specific statutes (FMC Act, Reserve Bank Act, Commerce Act etc.)
  • Issuer earnings webcasts, investor presentations and analyst-day transcripts publicly distributed by the issuer
Voluntary publication by the issuer; FMC Act §270 (continuous disclosure)
(6) Your right to access and correct

Under IPP 6 you may request access to the personal information we hold about you, and under IPP 7 you may request correction. The fastest route is the public dispute & right-of-reply form, which goes to our editorial review queue with a 5-business-day response target. Alternatively, email hello@nzxplorer.co.nz. The full editorial floor — including categories of personal data we always remove on request, the search-engine indexing policy, and the right-of-reply pathway for disputed inferences — is set out on our Data Principles page.

If you believe our handling of your personal information falls short of the Privacy Act 2020, you may also raise a complaint directly with the Office of the Privacy Commissioner at privacy.org.nz or 0800 803 909.
