Seeka provides an update on kiwifruit claim
On 29 June 2018, Seeka Limited [NZX:SEK] announced its response to the
decision of the High Court of New Zealand in respect of the claim by Strathboss
Kiwifruit Limited (including a class action for kiwifruit growers) and Seeka
against the Crown for losses in relation to the devastating outbreak of the PSA
disease in New Zealand.
The decision was in favour of growers for their loss, which includes Seeka as a
grower. However, Seeka did not succeed in its claims in relation to its losses as
a post-harvest operator.
On 24 July 2018 the Crown gave notice that it is appealing the decision in the
Court of Appeal.
Today the Claim Committee on behalf of the kiwifruit growers and Seeka gave
notice of its cross appeal of the decision, including in relation to the finding in
respect of Seeka as a post-harvest operator, and of its intention to support the
decision of the High Court in respect of the decision as it relates to kiwifruit
growers.
Seeka will update the market when any outcome of this appeal process is
known with sufficient certainty.
